General Terms and Conditions (GTC)
These Terms and Conditions govern the use of the DOGSY platform.
Only the German version of this text is legally binding.
1. Scope & Operator
These Terms and Conditions apply to the use of the «DOGSY» platform, operated by Pretty Wau GmbH, Fürstenlandstrasse 170, 9014 St. Gallen, Switzerland (hereinafter «DOGSY»). Contact: phone +41 77 502 55 13 · email info@dogsy.ch. By registering, the user («Dogsyaner») accepts these Terms and Conditions as well as the Privacy Policy.
2. DOGSY's Role – Pure Intermediation
DOGSY provides solely a technical platform for establishing contact between Dogsyaners. DOGSY is NOT a party to the services agreed between users, does not itself provide any care, transport or other dog-related services, does not supervise them and does not owe their conclusion or quality. All agreements are concluded exclusively and directly between the Dogsyaners involved.
3. Usage Requirements & Family Profiles
Use requires a personal login. An account may be opened by anyone who has reached the minimum age of their country of residence; minors under 18 additionally require the consent of their legal guardian and confirm it when registering (cf. Art. 19 of the Swiss Civil Code). DOGSY's paid offerings – namely the company account and the booking of advertising – are open exclusively to persons with full legal capacity aged 18 and over; where minors enter into paid obligations towards other users, this likewise requires the consent of their legal guardian. All users provide truthful, up-to-date information. Logins are personal and may not be passed on. Several people of one household may use a shared profile («family profile»); each member receives their own login with their own two-factor authentication, actions are attributable to the respective member, and the profile owner is responsible for member management. Registered dogs should be at least 12 weeks old.
4. Personal Responsibility & Users' Duty to Verify
Each Dogsyaner is responsible for independently verifying the suitability, reliability and identity of the other party before a dog or a service is handed over – in particular through meeting in person, follow-up questions, a preliminary meeting and clear written arrangements (service, time, place, emergency contact, veterinarian, remuneration). Handing over a dog or accepting a service is done at one's own risk and responsibility.
5. Verification Without Warranty
A verification seal (confirmed phone number/email, and where applicable an ID check in case of suspicion) increases trust but does NOT constitute any guarantee of a person's identity, suitability, reliability or safety. DOGSY does not vet users comprehensively and assumes no warranty for their information or conduct.
6. Services, Prices & Payments
Dogsyaners decide for themselves whether they offer services charitably (free of charge) or for remuneration, and set rates/flat fees themselves. Any payments for such services are settled directly between the users; DOGSY is not involved in this and charges no commission on it. Only the separate offer for advertisers is subject to a fee.
7. Exclusion of Liability
To the extent permitted by law, DOGSY excludes any liability for damage arising in connection with the intermediation, the conduct of users, or the performance or non-performance of agreed services – including personal, animal, property and financial loss, injury, illness, loss or death of an animal, theft as well as lost profit. DOGSY is not liable for the content, information or conduct of users. Liability exists only in the case of proven intent or gross negligence on the part of DOGSY and is limited in amount to the direct damage.
8. Insurance
Users are strongly advised to hold suitable private liability insurance (including animal custody/care damage). Clarifying insurance coverage is the users' own responsibility.
9. Obligations & Conduct
Users undertake to behave respectfully and lawfully, to comply with animal welfare and to provide truthful information. Harassment, fraud, spam, self-promotion outside the channels provided for it as well as circumventing the platform to harm third parties are prohibited.
10. Compliance with Statutory and Regulatory Requirements (Providers)
Users who offer care, training or other dog-related services on DOGSY («Providers») are solely responsible for complying with all statutory, cantonal and municipal regulations applicable to their activity. This includes in particular – without being exhaustive – any licensing, notification and training obligations for the commercial care of animals (e.g. under the Animal Welfare Ordinance) as well as cantonal requirements (e.g. mandatory proficiency or course obligations). With every listing, the Provider warrants that they meet the regulations applicable to them. DOGSY is a pure intermediation platform, does not check the fulfilment of these obligations and assumes no liability for it. Responsibility for the lawfulness of the offered service lies exclusively with the Provider.
11. Reports, Suspension & Termination
Abusive behaviour can be reported. DOGSY may remove content and, in the event of violations, warn, restrict or suspend accounts. Users can delete their account at any time.
12. Intellectual Property
DOGSY's trademark, logo, software and content are protected. Users grant DOGSY a simple right of use to their own content (e.g. profile texts, images) for the operation of the platform.
13. Amendments to the Terms and Conditions
DOGSY may amend these Terms and Conditions. Users will be informed of material changes; continued use is deemed acceptance.
14. Applicable Law & Place of Jurisdiction
Swiss law applies exclusively, to the exclusion of conflict-of-law rules. The exclusive place of jurisdiction is – to the extent permitted by law – St. Gallen (Switzerland).
15. Severability Clause
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
