The rule
Fighting dogs require a permit from the municipality (Art. 37 LStVG). Which dogs count as fighting dogs is set out in the Ordinance on Dogs with Increased Aggressiveness and Dangerousness in two groups, each including their crossbreeds: for Pit Bull, Bandog, American Staffordshire Terrier, Staffordshire Bull Terrier and Tosa Inu, the status of fighting dog is always presumed (category 1, § 1 Abs. 1). For Alano, American Bulldog, Bullmastiff, Bull Terrier, Cane Corso, Dog Argentino, Dogue de Bordeaux, Fila Brasileiro, Mastiff, Mastin Espanol, Mastino Napoletano, Perro de Presa Canario (Dogo Canario), Perro de Presa Mallorquin and Rottweiler, it is presumed as long as it has not been proven to the authority for the individual dog that it shows no increased aggressiveness and dangerousness towards people or animals (category 2, § 1 Abs. 2); with this certificate of non-dangerousness (Negativzeugnis), the permit requirement and the breeding ban no longer apply. Regardless of breed, training for increased aggressiveness can make a dog a fighting dog in an individual case (§ 1 Abs. 3).
